The Licensing Committee considered the report of the Executive Director of Development and Environment proposing the designation of three sites in the Borough as a licence street' for street trading under the provisions of the London Local Authorities Act 1990 (as amended) and, if the designation were agreed, to consider the granting of a street trading licence at those sites.
The Licensing Committee also considered an application for a variation to an existing street trading licence.
Applicants or their representatives were present for items 6a, 6b & 6d.
a. Site on the footway outside 10 Central Parade, Denning Avenue, Croydon, CR0 4DJ
The Licensing Committee considered appendix A to the report and the verbal representations made by the applicant and RESOLVED that the site be designated for the purposes of street trading, as set out in Appendix A, and that a street trading licence be granted on the Council's standard conditions.
b. Site on the footway outside 960 Brighton Road, Purley, CR8 2LP
The Licensing Committee considered appendix B to the report and the verbal representations made by the applicant.
At 7.15pm, the Licensing Committee RESOLVED under paragraph 5 of Part 1 of Schedule 12A of the Local Government Act 1972, as amended, that the press and public be excluded to enable Members to take confidential legal advice from the legal advisor to the Committee.
At 7.45pm, following consideration of the legal advice, the public was readmitted to the meeting room.
The applicant confirmed that, since the temporary licence had only been in place since 17 December 2014, no hot food had yet been served within the applied for area. The applicant also indicated that it was expected that food would be served from outside the enclosed area.
The Licensing Committee RESOLVED to adjourn consideration of the application until its next meeting.
The Committee reached this decision on for the following reasons:
health and safety concerns should hot food be served from the public pavement, especially given the location of the site on a busy junction, and how this would comply with the application submitted which the Council would have to enforce.
the existing temporary licence would allow the applicant to access how the applied for site could best be managed when serving hot food in the coming three months;
which in turn would enable the applicant to revisit the application to see whether any changes could be made to address the concerns of the Committee and resubmit to the next Licensing Committee on 17 June 2015
d. Site outside Spread Eagle, 39-41 Katharine Street, Croydon, CR0 1NX
The Licensing Committee considered appendix D to the report and the verbal representations made by the applicant and RESOLVED that the application to vary the hours and the goods and services provided on the existing street trading licence be GRANTED.
The Licensing Committee NOTED that the applicant indicated that facilities did exist for the storage of all the furniture used on the site, but that it was not currently the intention to remove all of it outside of operating hours.
c. Site on the footway outside 52 Westow Street, Upper Norwood, SE19 3AD
The Licensing Committee considered appendix C to the report and RESOLVED that the site be designated for the purposes of street trading, as set out in Appendix C, and that a street trading licence be granted on the Council's standard conditions.
