A7/17 APPOINTMENT OF CHAIR FOR THE MEETING

Councillor Khan proposed, and Councillor Bird seconded, that Councillor Avis be appointed Chair of the Sub-Committee.

 

The Sub-Committee RESOLVED to appoint Councillor Avis as Chair of the Sub-Committee.

The allocation of business was agreed as stated in the agenda.

A11/17 LICENSING ACT 2003: 91 HIGH STREET, SOUTH NORWOOD, SE25 6EA

The Licensing Sub-Committee considered the application for a Premises Licence at 91 High Street, South Norwood and the representations received as contained in the report of the Executive Director 'Place', the associated appendices to that report and, with the consent of all the parties, additional submissions received from the applicant in support of the application. The Sub-Committee further heard verbal representations from the applicant and his representative.
In addition, the Sub-Committee considered the verbal representations made at the hearing in opposition to the application by four members of the public.

The Licensing Manager reported to the Sub-Committee that the objections raised by the Council's Safety Team had been withdrawn as the applicant had amended their application to have the following two conditions added to the premises licence, were the application to be granted:
 

  1. No licensable activities shall take place until an inspection has taken place by the Food and Safety Team from Croydon Council. The licence holder shall notify the Food and Safety Team of the date that licensable activities are intended to commence and the inspection shall take place at least seven days before that date.
  2. No licensable activities shall take place at the premises until the Food and Safety Team has received written confirmation from the applicant's qualified engineer that the basement is safe for the intended use.

 

The Sub-Committee noted the amendments made by the applicant to their application during the meeting to incorporate the following conditions to the licence should the Sub-Committee be minded to grant, namely that:

 

  1. The basement be fitted with a sound limiter with the levels to be set by the Council's Environmental Health Team.
  2. If the premises is trading, or due to be trading, after 12 midnight on Thursdays there will be two SIA-approved supervisors on the premises.

 

The Sub-Committee, having reference to the licensing objectives under the Licensing Act 2003 and the Council Licensing Policy RESOLVED to grant the application on the basis that the amended application would satisfy the licensing objectives and the additional conditions would be designed to promote, in particular, the licensing objective of the prevention of public nuisance.

A12/17 LICENSING ACT 2003: 87-89 HIGH STREET, CROYDON CR0 1QF

The Licensing Sub-Committee considered the application for a Premises Licence at 87-89 High Street, Croydon and the representations received as contained in the report of the Executive Director 'Place' and the associated appendices to that report.

The applicant and the objectors were not present at the meeting.

The Licensing Manager reported to the Sub-Committee that the representations from the Council's Licensing Officer had been withdrawn as the applicant has amended their application to have the following three conditions added to the premises licence if the application were to be granted:
 

  1. The Licence holder shall operate an industry standards "Challenge 25" policy. The licence holder and each member of staff will ensure that any person who may attempt to purchase alcohol, and appears to be "under 25" shall be required to provide ‘suitable identification', to show that they are over "18" years of age. Note ‘Suitable identification' shall mean Passport; UK Driving License or a "PASS" approved proof of age card.
  2. The licence holder shall be responsible for ensuring that all members of staff are suitably trained in the sale of alcohol before they commence work in the licensed premises and re-trained at six monthly intervals thereafter. The employees ‘signed' individual training records shall be retained within these licensed premises, being made available to the employee, Local Authority Officer or Police Officer immediately upon request.
  3. The capacity for the building will be restricted to 60 persons due to the sole ‘evacuation/escape route' being to the front of the premises, this to be endorsed upon the Fire Risk Assessment. As and until such time as the issues of concern are fitted out to the specification required in Building Regulations.

 


The Sub-Committee noted that the applicant had amended their application following discussions with the Council's Public Safety and Licensing Officer to incorporate additional conditions to the licence should the Sub-Committee be minded to grant the licence.

The Sub-Committee, having reference to the licensing objectives under the Licensing Act 2003 and the Council Licensing Policy RESOLVED to grant the amended application on the basis that it would satisfy the licensing objectives to do so.
