The Licensing Sub-Committee considered the application for a variation to the premises licence at 76 Selsdon Park Road, CR2 8JT and the representations received as contained in the report of the Executive Director 'Place' and the associated appendices to that report. The Sub-Committee further heard verbal representations from the applicant and his representative.
In addition, the Sub-Committee considered the verbal representations made at the hearing in opposition to the application by members of the public.
The Committee were informed that, in consultation with the police, three additional conditions to the application where added which were detailed on paragraph 1.4 of Appendix A. At the hearing, the applicant also offered, as part of their application, an additional condition that could be attached to the application if the Sub-Committee were minded to grant it. The wording of the offered condition read as follows:
"Between the hours of midnight and 6am the cashier will hand to any customers a leaflet reminding the customer that the premises are in a residential area, to keep noise to a minimum, leave the premises quietly and respect the privacy of the local residents."
The Sub-Committee, having reference to the licensing objectives under the Licensing Act 2003, the statutory guidance and the Council Licensing Policy RESOLVED to grant the variation to the premises licence on the basis that they were satisfied that it would support the licensing objectives to do so. In particular, the Sub-Committee noted that the police had agreed conditions with the applicant in support of the crime and disorder prevention objective and the applicant had amended their application to include those conditions in support of the prevention of crime and disorder and the following condition in relation to the promotion of preventing public nuisance objective:
