Disclosure of Interests

In accordance with the Council’s Code of Conduct and the statutory provisions of the Localism Act, Members and co-opted Members of the Council are reminded that it is a requirement to register disclosable pecuniary interests (DPIs) and gifts and hospitality to the value of which exceeds £50 or multiple gifts and/or instances of hospitality with a cumulative value of £50 or more when received from a single donor within a rolling twelve month period. In addition, Members and co-opted Members are reminded that unless their disclosable pecuniary interest is registered on the register of interests or is the subject of a pending notification to the Monitoring Officer, they are required to disclose those disclosable pecuniary interests at the meeting. This should be done by completing the Disclosure of Interest form and handing it to the Democratic Services representative at the start of the meeting. The Chair will then invite Members to make their disclosure orally at the commencement of Agenda item 3. Completed disclosure forms will be provided to the Monitoring Officer for inclusion on the Register of Members’ Interests.

London Local Authorities Act 1990 Application for Street Designation Order pdf icon PDF 97 KB

The purpose of this report is to seek the Committee’s decision on the proposal to designate six sites in the Borough as ‘licence streets’ for street trading and the granting of a street trading licence under the provisions of the London Local Authorities Act 1990 (as amended).

The Committee considered the application to designate a section of public highway outside 6-8 Tudor Court, Russell Hill Road, Purley, CR8 2LA (Appendix A).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Transport for London (TfL) maintained; TfL had stated that they were happy with the proposed designation despite the kerbside clearance being two metres and under the usually required 2.8 metres.

 

The Applicant was present and provided further comment on the application. The Applicant stated that busy times on the street were usually during the morning and early afternoon with school children commuting and that tables and chairs would not be out during these times, other than weekends. In response to questions from the Committee about the clearance for waiting staff, the Applicant stated there was a metre clearance between tables for service.

 

In response to questions from the Committee about nearby designations, the Committee heard that the nearest was on the other side of the road.

 

The Committee RESOLVED:

 

1. To designate 6-8 Tudor Court, Russell Hill Road, Purley, CR8 2LA for the      purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside 5 Crown Parade, Crown Dale, Upper Norwood, SE19 3NG (Appendix C).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Applicant was present and provided further comment on the application. The Applicant stated that flower pots had been used to mark the designation during the temporary licence period and that a resident had asked that these be moved closer to the shop window as they had presented a potential trip hazard; the Applicant had complied.

 

In response to questions from the Committee, the Licensing Manager stated that Lambeth had not been consulted over the application.

 

The Committee RESOLVED:

 

1. To designate 5 Crown Parade, Crown Dale, Upper Norwood, SE19 3NG for   the purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside 39 Limpsfield Road, South Croydon, CR2 9LA (Appendix D).

Exclusion of the Press and Public

The following motion is to be moved and seconded where it is proposed to exclude the press and public from the remainder of a meeting:

 

“That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business on the grounds that it involves the likely disclosure of exempt information falling within those paragraphs indicated in Part 1 of Schedule 12A of the Local Government Act 1972, as amended.”
