Appointment of Chair

To appoint a Chair for the duration of the meeting.

Minutes:

It was MOVED by Councillor Islam and SECONDED by Councillor Bird and RESOLVED to appoint Councillor Patsy Cummings as Chair of the meeting.

Disclosure of Interests

Members and co-opted Members of the Council are reminded that, in accordance with the Members’ Code of Conduct and the statutory provisions of the Localism Act 2011, they are required to consider in advance of each meeting whether they have a disclosable pecuniary interest (DPI), some other registrable interest (ORI) or a non-registrable interest (NRI) in relation to any matter on the agenda. If advice is needed, Members should contact the Monitoring Officer in good time before the meeting.

If any Member or co-opted Member of the Council identifies a DPI or ORI which they have not already registered on the Council’s register of interests or which requires updating, they must urgently complete the disclosure form which can be obtained from Democratic Services at any time, copies of which will be available at the meeting for return to the Monitoring Officer.

Members and co-opted Members are required in general to disclose any relevant DPIs, ORIs or NRIs at the meeting –

  • Where the matter relates to a DPI they may not participate in any discussion or vote on the matter and must not stay in the room unless granted a dispensation.
  • Where the matter directly relates to the financial interest or wellbeing of an ORI they may not vote on the matter unless granted a dispensation.
  • Where a Member or co-opted Member has an NRI which directly relates to or affects their or a relevant person’s financial interest or wellbeing, whether they can participate in any discussion or vote on the matter or stay in the room depends on the detailed rules in paragraphs 7 of Appendix B of the Members’ Code of Conduct.

 

The Chair will invite Members to make their disclosure of interests orally at the meeting and they will also be recorded in the minutes.

Licensing Act 2003 - Application for a Premises Licence at 29-31 Limpsfield Road, Sanderstead, CR2 9LA pdf icon PDF 107 KB

The Sub-Committee is asked to determine whether to grant the application for a premises licence at 29-31 Limpsfield Road, Sanderstead, CR2 9LA.

The Chair outlined the procedures for the Licensing Hearing in line with the Licensing Act 2003 and the Council’s protocol.

 

The applicant Muhammad Waseem Khan-Sherwani was present.

 

The objector, Debbie Claydon, who had submitted representations was also present.

 

The Head of Environmental Health, Trading Standards and Licensing introduced the application to the Sub Committee.

 

The Head of Environmental Health, Trading Standards and Licensing explained that the application sought the licensable activity of the sale by retail of alcohol from Sunday to Thursday at 7am to 11pm and Friday and Saturday from 7am to midnight.

 

The Head of Environmental Health, Trading Standards and Licensing informed the Sub Committee that the application also sought the provision of regulated entertainment, specifically recorded music on Monday to Sunday from 7am to 11pm and the provision of late-night refreshment on Friday and Saturday from 11pm to midnight. The Head of Environmental Health, Trading Standards and Licensing clarified that the sale of hot food was not a licensable activity before 11pm.

 

The Head of Environmental Health, Trading Standards and Licensing explained that following discussions with the Police Licensing Officer as a responsible authority, the applicant had amended their application to have further conditions placed on the licence if the application was granted.

 

The objecting party, Debbie Claydon, was given the opportunity to speak. Debbie Claydon advised:

 

  • That she had moved into her property on the 9th October and as the licensing and planning applications were submitted just after she had moved in they had not been detected during her solicitors searches.
  • She was able to hear the ventilator which had been placed at the back of the restaurant from her property.
  • The rubbish from the work carried out on the premises was a concern.
  • The intention to play music outside the premises would negatively impact her living standards as she lived only two doors down from the premises.
  • The back operations of the restaurant could also be heard from her garden.
  • There was not an issue with a restaurant being on the premises, the problem was with how the restaurant operated and affected her living standards.

 

In response to questions from the Sub-Committee the objector confirmed that the access to her property was at the rear of the property through Cranleigh Close.

The applicant, Muhammad Waseem Khan-Sherwani, was given the opportunity to speak. Muhammad Waseem Khan-Sherwani advised:

 

  • The original application contained a quiet notice, an age verification policy and support for challenge 25.
  • Since the application had been made, he had been granted a temporary event notice up to the 23rd December, at this event they would sell alcohol and he had subsequently received a second temporary event notice from the licensing authority.
  • He had been a designated premises licence holder (DPS) for around 20 years.
  • He previously had a restaurant in Box Park called Yub and still owned a restaurant in South Croydon called Young Brasserie which had been there for 13 years.

Exclusion of the Press and Public

The following motion is to be moved and seconded where it is proposed to exclude the press and public from the remainder of a meeting:

 

“That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business on the grounds that it involves the likely disclosure of exempt information falling within those paragraphs indicated in Part 1 of Schedule 12A of the Local Government Act 1972, as amended.”
