The Chair outlined the procedures for the Licensing Hearing in line with the Licensing Act 2003 and the Council’s protocol.

Mr Emrah Bulbul (member of the management team) was present.

Mr Mario Shyti was present.

Simon Brown was present.

Councillor Jason Cummings was present.

The Head of Environmental Health, Trading Standards and Licensing introduced the application to the Sub Committee.

The Head of Environmental Health, Trading Standards and Licensing informed Members that the application was for a variation to the premises licence at 802 Wickham Road, Croydon. The application sought to vary the permitted hours for the sale by retail of alcohol on Sunday to Thursday from 11am to midnight and Friday and Saturday from 11am to 1:30am. The application was also for the provision of late night refreshment Sunday to Thursday from 11-pm to midnight and Friday and Saturday from 11pm to 1:30am. The Head of Environmental Health, Trading Standards and Licensing explained that late night refreshment only became a licensable activity from 11pm onwards.

The Head of Environmental Health, Trading Standards and Licensing stated that the applicant had submitted a copy of the variation application with a list of proposed conditions which would be added to the licence if the application was granted, in addition to dispersal and drugs policies.

The Head of Environmental Health, Trading Standards and Licensing Informed Members that following discussions with the police Licencing officer, the applicant had amended their application.

The objecting party, Simon Brown, was given the opportunity to speak. Simon Brown advised:

  • He had objected to previous applications at the site in accordance with the licensing objective ‘the prevention of public nuisance’.
  • There had been constant noise issues on the site.
  • There was no issue with anyone opening and/or trying to run a business in the area, especially if it added to the community.
  • The garden at the venue had a pergola roof which provided virtually no insulation and so even when it was closed, music can still be heard in the neighbouring properties.
  • Music was often played quite loudly for fairly long periods of time, and even past 11pm or 12pm.
  • Friday through to Monday tended to be the worst days for noise issues.
  • One of the main issues with the applicant seeking to open even later was that they already seemed to be opening past their current licence so there were doubts whether they would adhere to the conditions of a new licence.

 

The objecting party, Shaun Lochinger, was given the opportunity to speak. Shaun Lochinger advised:

  • The noise was very loud particularly on a Friday and a Saturday, this was even more of a disturbance during the summer as residents tended to open their windows more often.
  • There was an incident recently where the music was so loud that the windows were shaking, and people were coming out of their houses to see what the noise was.
