Appointment of Chair

To appoint a Chair for the duration of the meeting.

Minutes:

It was MOVED by Councillor Collins and SECONDED by Councillor Bird and RESOLVED to appoint Councillor Patsy Cummings as Chair of the meeting.

Disclosure of Interests

Members and co-opted Members of the Council are reminded that, in accordance with the Members’ Code of Conduct and the statutory provisions of the Localism Act 2011, they are required to consider in advance of each meeting whether they have a disclosable pecuniary interest (DPI), some other registrable interest (ORI) or a non-registrable interest (NRI) in relation to any matter on the agenda. If advice is needed, Members should contact the Monitoring Officer in good time before the meeting.

If any Member or co-opted Member of the Council identifies a DPI or ORI which they have not already registered on the Council’s register of interests or which requires updating, they must urgently complete the disclosure form which can be obtained from Democratic Services at any time, copies of which will be available at the meeting for return to the Monitoring Officer.

Members and co-opted Members are required in general to disclose any relevant DPIs, ORIs or NRIs at the meeting –

  • Where the matter relates to a DPI they may not participate in any discussion or vote on the matter and must not stay in the room unless granted a dispensation.
  • Where the matter directly relates to the financial interest or wellbeing of an ORI they may not vote on the matter unless granted a dispensation.
  • Where a Member or co-opted Member has an NRI which directly relates to or affects their or a relevant person’s financial interest or wellbeing, whether they can participate in any discussion or vote on the matter or stay in the room depends on the detailed rules in paragraphs 7 of Appendix B of the Members’ Code of Conduct.

 

The Chair will invite Members to make their disclosure of interests orally at the meeting and they will also be recorded in the minutes.

Licensing Act 2003 - Application For a Premises Licence at 60 Shirley Road, Croydon, CR0 7EP pdf icon PDF 107 KB

The Sub-Committee is asked to determine whether to grant the application for a premises licence at 60 Shirley Road, Croydon, CR0 7EP.

The Chair outlined the procedures for the Licensing Hearing in line with the Licensing Act 2003 and the Council’s protocol.

Mr Faisal Khan Niazi was present.

The Head of Environmental Health, Trading Standards and Licensing introduced the application to the Sub Committee.

The Head of Environmental Health, Trading Standards and Licensing informed Members that the application for a premises licence was for the provision of late-night refreshment, Sunday to Thursday from 11pm until 1am and Friday to Saturday 11pm until 1:30am.

The Head of Environmental Health, Trading Standards and Licensing stated that following discussions with the Police Licencing Officer the applicant had amended their application and now sought the provision of late-night refreshment for slightly earlier hours to what was requested in the original application.

The Head of Environmental Health, Trading Standards and Licensing Informed Members that the applicant sought to have the conditions at appendix A2 in the agenda placed on the licence if the application was granted; these were conditions that had been discussed with the Police Licencing Officer.

The applicant, Faisal Khan Niazi, was given the opportunity to speak. Faisal Khan Niazi advised:

  • That he had not interacted with the person who had objected to the application, as they had never raised any problems with him directly.
  • The business used a hybrid Toyota Prius for delivers which did not make much noise, they also parked the car far from the shop to avoid disturbing their neighbours.
  • The objector stated in their representations that the sound of the extractor fan was very loud, however, they had fitted a silencer onto their extractor fan to reduce the noise emitted.
  • There were several other businesses near the shop which operated after 12am such as Tesco and a pub which was within 200 metres that was open very late.
  • Most of the pub customers go to other take away shops when they left the pub
  • He applied for the late-night licence to help his business to survive as it was currently a very difficult time.
  • If the application was granted, then it would allow him to run his business smoothly and survive.

 

In response to questions from the Sub-Committee the applicant advised that the extractor fan was installed about 6 or 7 months ago, the silencer was clearly visible and prevented the extractor fan from making any sound.

In response to questions from the Sub-Committee the applicant explained that they had a Toyota Prius which was a hybrid car that did not make a lot of noise. They were also not a very big business, after 11pm they had one delivery driver and one staff member inside the shop and the staff were all over the age of 18. 

In response to questions from the Sub-Committee the applicant informed Members that he had not contacted any residents as they had not raised any issues with any how the shop operated.

Exclusion of the Press and Public

The following motion is to be moved and seconded where it is proposed to exclude the press and public from the remainder of a meeting:

 

“That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business on the grounds that it involves the likely disclosure of exempt information falling within those paragraphs indicated in Part 1 of Schedule 12A of the Local Government Act 1972, as amended.”
