London Local Authorities Act 1990: Applications for Street Designation Orders

Minutes:

The Chair began the item asking Members for confirmation that they were happy to  re-arrange the order of applications to be considered allow for additional time for applicants not already present to attend the Chamber. Members confirmed their agreement and the Chair therefore took the application for 279 South Norwood Hill (Appendix D) first, as the applicant was present, followed by the application for 273 South Norwood Hill (Appendix C) as the applicant had already notified the Committee of her non-attendance. The applications were thereafter considered in the order as set out within the agenda

 

The Committee considered an application for a street designation order and street trading licence for 279 South Norwood Hill as detailed in appendix D to the report.

 

The Licensing Manager detailed the legal framework and process for considering street designations then directed the Members through the application for decision. It was confirmed that no objections had been received for the application, and the applicant was present at the meeting.

 

In response to questions from the Committee the applicant confirmed that he was able to keep his display within the designated width and there were no encroachment issues with larger plants such as Christmas trees, which were netted to keep them within the designated width.

 

The Committee RESOLVED to:

1 To designate the specified area outside 279 South Norwood Hill for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.

 

The Committee considered an application for a street designation order and street trading licence for 273 South Norwood Hill as detailed in appendix C to the report.

 

The Licensing Manager detailed the nature of the application for decision as set out in the report by the Director, Place. It was confirmed that no objections had been received for the application, and the applicant had informed the Committee that she was unable to attend.

 

Members asked questions pertaining to the private forecourt for the premises and its relationship to the permitted width to the edge of the curb. Members additionally asked if the application could accommodate a barrier and table service within the permitted width. Officers confirmed that there was enough space for inclusion of the barrier and table service though it was not intended by the applicant that table service would be available in any event.

 

The Committee RESOLVED to:

1 To designate the specified area outside 273 South Norwood Hill for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.

 

The Committee considered an application for a street designation order and street trading licence for 8 Station Road as detailed in appendix A to the report.

 

The Licensing Manager detailed the nature of the application for decision as set out in the report by the Director, Place. It was confirmed that no objections had been received for the application, and the applicant was not present at the meeting.

 

Members briefly discussed the display layout as it appeared in the provided photographs.

 

The Committee RESOLVED to:

1 To designate the specified area outside 8 Station Road for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.

The Licensing Manger detailed the nature of the application for decision as set out in the report by the Director, Place. It was confirmed that no objections had been received for the application, and the applicant was not present at the meeting.

 

The Committee RESOLVED to:

1 To designate the specified area outside 12A Station Road for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.

 

The Committee considered an application for a street designation order and street trading licence for 32 London Road as detailed in appendix E to the report.

 

The Licensing Manager detailed the nature of the application for decision as set out in the report by the Director, Place.. It was confirmed that no objections had been received for the application, and the applicant was not present at the meeting.

 

Members raised concerns over the bus stop directly opposite the display. Officers noted that this was not uncommon in the borough and the designated width was to the shelter’s foot stumps and not the roof. Concern was also raised over the height of the food display from the pavement; officers assured Members that such issues would be dealt with by the Food Safety team.

           

The Committee RESOLVED to:

1 To designate the specified area outside 32 London Road for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.

 

The Committee considered an application for a street designation order and street trading licence for 63 London Road as detailed in appendix F to the report.

 

The Licensing Manager detailed the nature of the application for decision as set out in the report by the Director, Place. It was confirmed that no objections had been received for the application, and the applicant was not present at the meeting.

 

The Committee RESOLVED to:

1 To designate the specified area outside 63 London Road for the purposes of street trading; and

2 To grant a street trading licence to the Applicant.
