MINUTES - PART A
A1/14 MINUTES OF THE MEETING HELD ON THURSDAY 21ST NOVEMBER 2013

RESOLVED: that the minutes of the Licensing Committee meeting held on Thursday 21 November 2013 be signed as an accurate record of the meeting.

A2/14 DISCLOSURE OF INTEREST

A4/14 EXEMPT ITEMS

RESOLVED: that the allocation of business between Part A and Part B of the agenda be confirmed as printed.

A5/14 LONDON LOCAL AUTHORITIES ACT 1990: APPLICATIONS FOR STREET DESIGNATION ORDERS

The Licensing Committee considered the report of the Executive Director of Development and Environment proposing the designation of four sites in the Borough as a ‘licence street' for street trading under the provisions of the London Local Authorities Act 1990 (as amended) and, if the designation were agreed, to consider the granting of a street trading licence at that site.

 

Having considered appendix A, the Licensing Committee RESOLVED:

a) that the site on the footway outside 227 Lower Addiscombe Road, Croydon, CR0 6RB, be designated for the purposes of street trading, as set out in Appendix A, and that a street trading licence be granted on the Council's standard conditions.

 

Having considered appendix C, the Licensing Committee RESOLVED:

c) that the site on the footway outside 2-4 Westow Street, Upper Norwood, SE19 3AH, be designated for the purposes of street trading, as set out in Appendix C, and that a street trading licence be granted on the Council's standard conditions.

Officers advised the Committee that the measurements on appendix D should have read a trading area of 0.86m tapering to 0.67m rather than 1m.

 

Having considered appendix D, the Licensing Committee RESOLVED:

d) that the site on the footway outside 348 Limpsfield Road, Croydon, CR2 9BX, be designated for the purposes of street trading, as set out in the application at Appendix D, and that a street trading licence be granted on the Council's standard conditions with the following additional condition:

  • That any parasols used in the provision of the service be of sufficient height so as not to present a hazard to pedestrians or customers.
A6/14 CAMERA RESOLUTION

The Licensing Committee considered appendix B to the report and the verbal representation of the applicants. Having done so, the Licensing Committee RESOLVED under paragraph 5 of Part 1 of Schedule 12A of the Local Government Act 1973, as amended that the press and public be excluded to enable Members to take confidential legal advice from the legal advisor to the Committee.

 

Following consideration of the legal advice, the public was readmitted to the meeting room and the Licensing Committee RESOLVED that the site on the footway outside 1366-1368 London Road, Norbury, SW16 4DE not be designated for the purposes of street trading.

 

The Committee reached this decision on the basis that the site falls within the Council's Street Trading Policy as it applies to London Road and consequently the Committee were mindful of considerations relating to the safe and convenient passage of pedestrians on the street. The objections received indicated that there were already concerns about customers congregating outside the premises and the submissions made by the Applicant did not satisfy the Committee that this would not be a problem and hence show sufficient reason why it should step outside its Policy and designate the site.
