MINUTES - PART A
A1/15 APPOINTMENT OF CHAIR FOR THE MEETING

RESOLVED: that Councillor Jane Avis be appointed Chair for the meeting of the Sub-Committee.

A5/15 LICENSING ACT 2003: APPLICATION FOR PREMISES LICENCE: 239 KING HENRY'S DRIVE, NEW ADDINGTON, CROYDON, CR0 0PS.

At 6.37pm, the Sub-Committee RESOLVED to withdraw to separate room to take advice from its legal advisor in respect of the paperwork submitted earlier in the day by the representative of the applicant.

 

At 6.45pm, the Licensing Sub-Committee returned to the meeting room and the Chair of the Sub-Committee read the following resolution:

The Sub-Committee RESOLVED that it is in the public interest to adjourn the hearing of this matter until a later date in accordance with the provisions of the regulation 11 of the Licensing Act 2003 (Hearings) Regulations 2005.

 


In deciding to adjourn the hearing, the Sub-Committee has had regard to:

  • the nature of the objections raised by the responsible authorities and interested parties which pertain predominantly to public safety and prevention of public nuisance,
  • the late receipt of supporting evidence from the applicant on these objections detailing how the applicant considers the objections may be met,
  • the inability of responsible authorities' to adequately assess the merits of the applicant's proposals to address potential public nuisance or public safety concerns which have been raised within the time frame and to be in a position to address the Sub-Committee on such measures and their impact on the licensing objectives.

 

Accordingly the hearing of this application is hereby adjourned until 6.30pm on 1 April 2015 for hearing.


Responsible authorities and interested persons have until 12 noon on 17 March 2015 to make any further comments or submissions arising from the applicant's supporting evidence, which have been made available to the parties in hard copy this evening.


In particular, the Sub-Committee wishes to hear further from the Licensing Officer, the Food and Safety Officer and the Noise Pollution Officer.


The Applicant thereafter has a final opportunity until 12 noon on 24 March to make final comments arising from further submissions from responsible authorities and interested persons and the Sub-Committee would not expect to receive further late supporting evidence from the Applicant.
Accordingly this meeting stands adjourned until 1 April 2015 at 6.30pm.
