A6/15 APPOINTMENT OF CHAIR FOR THE MEETING

RESOLVED: that Councillor Karen Jewitt be appointed Chair for the meeting of the Sub-Committee.

A10/15 LICENSING ACT 2003: REVIEW OF PREMISES LICENCE: MANGO BAR, 208-210 BRIGHTON ROAD, COULSDON, SURREY, CR5 2NF

The Licensing Sub-Committee considered the application for a review of the Premises Licence at Mango Bar, 208-210 Brighton Road, Coulsdon, Surrey CR5 2NF.

 

The Licensing Sub-Committee RESOLVED, under Section 100A (4) of the Local Government Act, 1972, that the press and public be excluded from the meeting so that CCTV footage at the premises could be shown on the grounds that it involves the likely disclosure of exempt information falling within those paragraphs 1 and 2 of Schedule 12A of the Local Government Act 1972, as amended.
 

The Public interest Test provided for in paragraph 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005 was applied by the Sub-Committee and it is believed favours exclusion of the information from the Press and Public as the faces of individuals in the footage had not been blanked out.

The Licensing Sub-Committee considered the representations received from interested parties, a Ward Councillor and the Premises Licence Holder as contained in the report of the Executive Director ‘Place'.

 

The Sub-Committee also considered the verbal representations (including the CCTV recording) made at the hearing by the police (the applicant), interested parties, a Ward Councillor and the Premises Licence Holder and his representatives.

 

The Licensing Sub-Committee did not consider additional information provided to it on the day of the hearing by the Premises Licence Holder as Members had not had sufficient time to read it and applied its discretion not to take into account the documents as provided for in Regulation 18 of the licensing act 2003 (hearings) regulations 2005.

 

The Sub-Committee, having reference to the licensing objectives under the Licensing Act 2003 and the Council Licensing Policy RESOLVED to modify the conditions of the licence as follows:

 

The times the licence authorises the carrying out of licensable activities


The sale by retail of alcohol -
• Monday to Thursday 1200 hours (noon) until 2330 hours
• Friday and Saturday 1200 hours (noon) until 0030 hours on the following days
• Sunday 1200 hours (noon) until 2300 hours
• Christmas Eve and New Year's Eve 1200 hours (noon) until 0200 on the following days

 

The provision of regulated entertainment -
• Live music and anything of a similar description to live music
• Friday and Saturday 2000 hours until 0000 hours (midnight)
• Christmas Eve and New Year's Eve 2000 hours (noon) until 0100 on the following days

 

Recorded music -
• Friday and Saturday 2000 hours until 0100 hours on the following days

The provision of late night refreshment (for non-residents) -
• Monday to Saturday 2300 hours until 2330 hours
*There are no restrictions upon the provision of food to residents of the premises


The opening hours of the premises -
• Monday to Thursday 1200 hours (noon) until 0000 hours (midnight)
• Friday and Saturday 1200 hours (noon) until 0100 hours on the following days
• Sunday 1200 hours (noon) until 2300 hours
• Christmas Eve and New Year's Eve 1200 hours (noon) until 0200 on the following days

 

This decision is based on the Sub-Committee's view of the promotion of the licensing objectives relating to the promotion of crime and disorder and the prevention of public nuisance.
