A36/15 APPOINTMENT OF CHAIR FOR THE MEETING

RESOLVED: that Councillor Jane Avis be appointed Chair for the meeting of the Sub-Committee.

A40/15 LICENSING ACT 2003 - HEARING OF REPRESENTATIONS FROM PREMISES LICENSE HOLDER FOLLOWING APPLICATION FOR SUMMARY REVIEW AND SUBSEQUENT SUSPENSION OF LICENCE

The Sub-Committee is asked to consider the representations from the premises licence holder against the interim step taken to suspend the premises licence at Apatura, 14 South End, Croydon, CR0 1DL.

 

The sub-committee must determine whether the interim steps are appropriate for the promotion of the licensing objectives and determine whether to withdraw or modify the steps taken.

 

The Licensing Sub-Committee considered representations from the premises licence holder of Apatura, 14 South End, Croydon CR0 1DL contained in the report of the Executive Director ‘Place' against the interim steps decision to suspend the premises licence which was taken on 23 September 2015.

 

The Licensing Sub-Committee also considered the verbal representations made at the hearing by the premises licence holder, its representative and the police.

 

The Licensing Sub-Committee having regard to the four licensing objectives of the Licensing Act 2003 RESOLVED that the interim step of suspension of the licence should be withdrawn.

 

The reasons for this decision are:

 

1) The Licensing Sub-Committee was concerned with the apparent non-compliance of the conditions of the licence for a number of years;

2) However in relation to the concerns of serious crime or disorder which had led to the original suspension, it was satisfied that these concerns and related non-compliance with conditions had now been sufficiently addressed such that suspension pending review of the licence was no longer required in relation to the promotion of the licensing objectives.
