A43/15 APPOINTMENT OF CHAIR FOR THE MEETING

RESOLVED: Councillor Jane Avis was appointed Chair for the meeting.

A47/15 LICENSING ACT 2003: APPLICATION FOR REVIEW OF PREMISES LICENCE: 216 MITCHAM ROAD, CROYDON

The Licensing Sub-Committee considered the application for a review of the premises licence at 216 Mitcham Road, Croydon and the representations received from the police as applicant contained in the report of the Executive Director ‘Place'. The Sub-Committee also considered additional written submissions from the premises licence holder.

 

The Sub-Committee also considered the verbal representations made at the hearing by the police and the premises licence holder and their representative.

 

Following a request from the Police to show a DVD containing CCTV footage the Licensing Sub Committee RESOLVED that, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A to the Act, namely the images of third parties during the transmission of the footage.

 

The Public Interest Test provided for in paragraph 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005 has been applied and favours exclusion of the information from the Press and Public.

 

Members of the press and public were therefore left the meeting at 11:00 and returned at 11:05am after the DVD had been shown.

 

The Sub-Committee considered whether taking any of the following steps were necessary to promote the four licensing objectives:

• To modify the conditions of the licence
• To exclude a licensable activity from the scope of the licence
• To remove the designated premises supervisor
• To suspend the licence for a period not exceeding 3 months
• To revoke the licence

 

The Sub-Committee having regard to the four licensing objectives of the Licensing Act 2003 and the Council's Licensing Policy RESOLVED to deal with the application for review of the premises license by SUSPENDING the Premises Licence for one month for the following reasons: The premises licence holder has continued to breach condition 4 of his premises licence; staff on the premises were unable to operate the CCTV system following requests by the Police. This decision is made by the Licensing Sub-Committee to ensure compliance and promotion of the licensing objective of the prevention of crime and disorder.

 

The Licensing Sub-Committee meeting adjourned at 12:40pm in order to move to the Council Chamber, the Town Hall, Katharine Street, Croydon. The meeting resumed at 1:12pm.
 

A48/15 LICENSING ACT 2003: APPLICATION FOR REVIEW OF PREMISES LICENCE: 11 MARKET PARADE, SOUTH NORWOOD SE25

The Licensing Sub-Committee considered the application for a review of the premises licence at 11 Market Parade, Portland Road, South Norwood and the representations received from the police as applicant contained in the report of the Executive Director ‘Place'.

 

The Sub-Committee also considered the verbal representations made at the hearing by the police and the premises licence holder and their representative.

 

The Sub-Committee considered whether taking any of the following steps were necessary to promote the four licensing objectives:

• To modify the conditions of the licence
• To exclude a licensable activity from the scope of the licence
• To remove the designated premises supervisor
• To suspend the licence for a period not exceeding 3 months
• To revoke the licence

 

The Licensing Sub-Committee having regard to the four licensing objectives of the Licensing Act 2003 and the Council's Licensing Policy RESOLVED to deal with the application for review of the premises license by SUSPENDING the Premises Licence for 72 hours from 1600 hours today (15 October 2015) pending satisfaction by the Police of compliance with condition 1. This is to ensure compliance with the licensing objective of the prevention of crime and disorder.
