A62/15 APPOINTMENT OF CHAIR FOR THE MEETING

RESOLVED: that Councillor Jane Avis be appointed Chair for the meeting of the Sub-Committee.

A66/15 LICENSING ACT 2003 - REVIEW OF PREMISES LICENCE

The Licensing Sub-Committee considered the application for a review of the premises licence at 791 London Road, Thornton Heath and the representations received from the police as applicant contained in the report of the Executive Director ‘Place'.

 

The Sub-Committee also considered the verbal representations made at the hearing by the police and the premises licence holder and his representative.

 

The Sub-Committee considered whether taking any of the following steps were necessary to promote the four licensing objectives:

• To modify the conditions of the licence
• To exclude a licensable activity from the scope of the licence
• To remove the designated premises supervisor
• To suspend the licence for a period not exceeding 3 months
• To revoke the licence

 

The Sub-Committee having regard to the four licensing objectives of the Licensing Act 2003, in particular the prevention of Crime and Disorder objective and the Council's Licensing Policy RESOLVED to deal with the application for review of the premises license by imposing additional conditions on to the Premises Licence as agreed between the Police and the Premises Licence Holder; such conditions to replace the conditions currently at Annex 2 to the Premises Licence, namely:

 

1. Conditions 1-8 and 10-18 as set out in the additional conditions supplementary information presented by the Police;

 

2. Condition 9 to read:

On the days that the premises are open to the public, no members of the public are to be admitted after 0200 hours

 

3. Condition 19 to read:

All private hire events shall be notified to the Metropolitan Police Service in writing no less than 7 days before such event; and

All private hire events shall be undertaken in consultation with the Metropolitan Police Service.

 

4. Terminal hours for licensing activities are amended as specificed in the submissions by the Police save that the opening hours are to read:

Monday to Thursday 1200 (noon) until 0130 hours on the days following

Friday to Sunday 1200 (noon) until 0430 hours on the days following

 

5.  The premises shall not operate until the Metropolitan Police have confirmed in writing that they are satisfied with the CCTV.

 

6.  The Licensing Sub-Committee RESOLVED that the additional conditions imposed following representations against interim steps shall cease to have effect, being replaced by specific conditions imposed at this hearing.
