A14/16 APPOINTMENT OF CHAIR FOR THE MEETING

Councillor Jane Avis was appointed Chair for the meeting.

A18/16 LICENSING ACT 2003 - APPLICATION TO VARY A PREMISES LICENCE - 882 LONDON ROAD, THORNTON HEATH, CR7 7PB

The meeting adjourned at 7:02pm for Members to consider their decision and reconvened at 7:40pm for the decision to be announced.
 

 

The Licensing Sub-Committee considered the Application for the variation of a Premises Licence at 882 London Road, Thornton Heath CR7 7PB and the representations received from the Police as contained in the report of the Executive Director ‘Place’.

The Sub-Committee also considered the verbal representations made at the hearing by the premises licence holder as applicant, his representative and the Police.

The Sub-Committee considered this case on its merits and having reference to the licensing objectives under the Licensing Act 2003 and the Council Licensing Policy RESOLVED not to grant this application to vary the premises licence.

The Sub-Committee took into account that the Council's Licensing Policy states that there will be a presumption that permitted hours of sale of alcohol will be restricted in respect of shops in the Cumulative Impact Zone which this premises is within.

The Sub-Committee is aware of the importance of preventing crime and disorder and is of the view that extending the hours is contrary to this.

The Sub-Committee is committed to reducing crime and disorder and creating an environment where people feel safe. This premises is located within the Cumulative Impact Zone and no exceptional circumstances have been raised which would alter the presumption that this application would be refused.

The Members of the Sub-Committee took the opportunity to confirm that the decision was based solely on the licensing objective and the Council's Licensing Policy and not the merits of the applicant personally.

 

 

The meeting adjourned after the announcement of the decision to allow Members to hold a pre-meeting with the legal advisor in relation to the following item. 

 

The meeting re-started at 8:00pm.

A19/16 LICENSING ACT 2003 - REVIEW OF A PREMISES LICENCE - THE GOAT PUBLIC HOUSE, 1-3 BROOM ROAD, SHIRLEY, CROYDON

The Licensing Sub-Committee considered the Application for a Review of a Premises Licence at The Goat Public House, 1-3 Broom Road, Shirley, Croydon and the representations received from the Police as contained in the report of the Executive Director ‘Place’.

 

The Sub-Committee also considered the verbal representations made at the hearing by the police as applicant, the representative of the freeholders and the premises licence holder and his representative.

 

The Licensing Sub-Committee adjourned to consider its decision at 9:18pm.  At 9:56pm, the Sub-Committee reconvened and the Chair informed all those present that it needed more time for it's deliberations and that the decision would be sent to all parties within 5 days.  The meeting concluded at 9:57pm.  The decision was sent to all parties on 10 April 2016.

 

The Sub-Committee considered whether taking any of the following steps were necessary to promote the four licensing objectives:
• To modify the conditions of the licence
• To exclude a licensable activity from the scope of the licence
• To remove the designated premises supervisor
• To suspend the licence for a period not exceeding 3 months
• To revoke the premises licence

 

The Sub-Committee, having reference to the licensing objectives under the Licensing Act 2003 and the Council Licensing Policy RESOLVED to remove the Designated Premises Supervisor (DPS) because the Sub-Committee considered that the current DPS has failed to ensure the licensing conditions are met.

 

The removal is necessary and proportionate in order to prevent crime and disorder and public nuisance.

 

The Sub-Committee was mindful that the Councils Licensing Policy provides that licensing authorities should not merely repeat warnings that have already been given and should take this into account when considering further actions.

 

The Sub-Committee noted that the Police have issued warnings and the licence was modified accordingly. However since then it remains that the licensing conditions have not been complied with. For example:
• No incident report in the incident book on 25 December 2015
• No security guards/door supervisors on 25 December 2015
• No CCTV coverage from the incident on 25 December 2015 was made available to the Police on the visit on 6 January 2016
• As at 6 January 2016 CCTV was not recording for the required number of days
