MINUTES - PART A
A39/16 APPOINTMENT OF CHAIR FOR THE MEETING

Councillor Clouder proposed, and Councillor Bird seconded, that Councillor Jewitt be appointed Chair.

 

The Sub-Committee RESOLVED to appoint Councillor Jewitt as the Chair.

The allocation between Part A and Part B of the meeting was agreed.

A43/16 LICENSING ACT 2003 - TEMPORARY EVENT NOTICE SUBJECT TO POLICE OBJECTION NOTICE

The Licensing Sub-Committee considered the objection to a Temporary Event Notice at 791, London Road, Thornton Heath, CR7 6AW, as contained in the report of the Executive Director ‘Place'.

 

The Sub-Committee also considered the verbal representations made at the hearing by the Police and the Applicant and the Premises Licence Holder.


The Sub-Committee, having regard to the objection notice issued by the Police, considered it UNNECCESSARY to issue a counter notice under Section 105 of the Licensing Act 2003. The Sub-Committee considered the notice objection issued by the Police, with particular regard to the prevention of crime and disorder objective, the Licensing Act 2003, the Statutory Guidance issued by the Secretary of the State and the representations presented by the Police Objection Notice. The type of licensable activities intended to be provided at the premises and the proposed timings of the event was considered. The Sub-Committee took the view that the event would not threaten the prevention of crime and disorder objectives.

 

The Sub-Committee GRANTED the Temporary Event Notice and imposed the existing licensing conditions on the following terms:

 

That the times of the licensable activities are to be as stated in the current Premises Licence for the premises:

1. Sale of alcohol - Friday to Sunday 1200 hours (noon) until 0130 hours the following days.
2. Regulated entertainment, including live music - Friday to Sunday 2000 hours until 0200 hours the following days.
3. Late night refreshment - Friday to Sunday 2300 hours until 0200 hours the following days.

In addition, all conditions attached to the current Premises Licence at Annexes One & Two of the report shall apply for the duration of the licensable activities permitted by the temporary event notice for the event.
