A65/16 LICENSING ACT 2003 - TEMPORARY EVENT NOTICE SUBJECT TO POLICE OBJECTION NOTICE

The Licensing Sub-Committee considered the objection to a Temporary Event Notice at 58-60 Windmill Road, Croydon, CR0 2XP, as contained in the report of the Executive Director ‘Place'.

The Sub-Committee also considered the verbal representations made at the hearing by the representative from the Pollution (Noise) and the Applicant and her representative. The Sub-Committee also considered the additional documentation provided by the Pollution Team that was submitted at the hearing, and to which the Applicant gave consent to be considered by the Sub-Committee.

 

The Sub-Committee, having regard to the objection notice, considered it UNNECESSARY to issue a counter notice under Section 105 of the Licensing Act 2003.


The Committee considered the notice of objection with particular regard to the prevention of nuisance objective, the Licensing Act 2003 and the Statutory Guidance issued by the Secretary of State and the representations presented by the Council's Pollution (Noise) Team. The type of licensable activities intended to be provided at the premises and the proposed timings of the event were considered. The Committee took the view that the event would not undermine the prevention of nuisance objective.

In arriving at this decision, the Sub Committee has considered the various measures installed by the Applicant to mitigate noise pollution within the premises. In particular the Sub Committee takes note of the sound inhibitors recently installed within the premises. The Sub Committee has also taken into consideration the fact that the application is for an event between 8pm and midnight on New Year's Eve. The Sub Committee uses its local knowledge and experience that on New Year's Eve, there is usually a higher level of noise in celebration of the New Year and therefore there is a lower risk of public nuisance in view of the general activities on that particular day. The Sub Committee advises the Applicant to ensure that she is available at the premises during the event to ensure compliance with the relevant noise related issues.
