06/04/2023 - Mayor of London – expansion of Ultra Low Emission Zone / Section 8 agreement ref: 2027    Recommendations Approved

An expansion of the Mayor of London’s Ultra Low Emission Zone (ULEZ) expansion is planned to extend the boundaries to outer London boroughs. Transport for London (TfL) operate the ULEZ and have an implementation timetable across Greater London in order to ensure that all necessary Works are completed in sufficient time ahead of the London-wide ULEZ scheme commencement date of 29 August 2023.

Croydon like many other outer London Boroughs have raised strong objections regarding the ULEZ expansion proposal as part of the recent proposal. This report examines the issues surrounding the expansion of the ULEZ and considers whether Croydon Council should enter into a Section 8 agreement with TfL regarding the implementation of the expansion of the ULEZ. It outlines the reasons why Croydon Council might enter into a section 8 agreement but also the existing legal protections offered should Croydon decide to not enter the agreement.

Decision:

2.1 To agree that as part of the application process a review of an applicant’s income takes place, to determine eligibility to this scheme.

 

2.2 To agree that the level of support provided will be to mitigate 10% of the Croydon rise in council tax for 2023/24.

 

2.3 To agree support is provided as a council tax reduction in the form of a Locally Defined Discount.

 

2.4 To agree that the maximum income before being ineligible for this scheme is set to varying levels, depending on household composition.

 

2.5 To agree additional staffing to administer this scheme is prudent and financially viable.

 

2.6 To agree all requests will be made via an application, once verified an automatic award of the reduction will be made.

06/04/2023 - Ringfenced RTB Agreement ref: 2026    Recommendations Approved

In 2018 the council were offered grant funding from the GLA under the Building Council Homes for Londoners (BCHfL) programme. The grant funding was for £48,598,000 to build 326 London Affordable Rent/Social Rent homes and also included £12,690,000 Right To Buy ringfence grant allocation to build 141 homes.

Whilst the Council signed the overarching agreement with the GLA for the £48.598m in August 2019, the Council failed to ever legally sign the Ringfence RTB agreement with the GLA.

Although the Council didn’t sign the agreement, the then Executive director of Place Shifa Mustafa did ‘opt in’ to the ringfenced RTB offer on the Council’s behalf in August 2019.

Since this opt-in the Council has operated as if the agreement was signed and has met all the conditions in the agreement.

The GLA have recently highlighted the lack of legal agreement with the Council and asked that this is retrospectively put in place in order to release the funds.

As part of the agreement £1.483m was transferred into the ringfence RTB fund. The Council was given until March 2022 to identify the units this would be allocated to and then until May 2022 to use the funds. The Council identified 10 x 3-bedroom homes at Tollers Lane and acquired the units March 2022 including a request for £1.483m from the GLA RTB ringfence pot as part of the purchase. The feasibility for the financial funding of these units was based on receiving the RTB ringfenced funds. Without approval to retrospectively enter into this agreement with the GLA the Council would not be able to access the £1.483m available from the GLA.

1.1.         Delegate decisions regarding in-year amendments to the council’s fees and charges schedule (previously approved by the Executive Mayor on 22 February, 2023) to the council’s Corporate Director of Resources (or in their absence, the Director of Finance), following consultation with the Cabinet Member for Finance.

 

1.2.         Agree to delete paragraph 3.1 of the Adult Social Care Policy – Charging for Adult Social Care Policy Statement, and replace it with the following “3.1 A schedule of LBC adult social care fees and charges is published annually, which is approved by the Executive Mayor in time for the start of each financial year. In year changes to fees and charges may be required, and will be approved by the council’s Corporate Director of Resources and Section 151 Officer (or in their absence, the Director of Finance), through delegated authority from the Executive Mayor”.

 

1.3.         Note that in relation to amending fees and charges which relate to council (non-executive) functions, separate approvals will be required from the relevant Committees, or officers.

As per the Delegation by Mayor in Cabinet on 30th November 2022, the Corporate Director of Resources and Section 151 Officer, in consultation with Cabinet Member for Finance and Corporate Director of Housing, is recommended to:

 

1.1.         Approve the acquisition of 12 new homes as a bulk purchase, including the freehold of the site, from Brick by Brick for £3.377m on the terms set out in this report.

 

1.2.         Note and approve the acceptance of £1.2m of GLA funding on the terms set out in the Grant Agreement with the GLA, in connection with this purchase with the balance to come from Borrowing or internal HRA resources.

 

1.3.         Note that the budget for this has been provided within the HRA Capital Programme and the acquisition will be funded using HRA borrowing but will be reviewed at year end should the HRA have further capacity to fund the acquisition using HRA reserves.
