The Licensing Committee considered Appendix C to the report and the verbal representation of the applicant.
Having done so, the Licensing Committee RESOLVED under paragraph 5 of Part 1 of Schedule 12A of the Local Government Act 1973, as amended that the press and public be excluded to enable Members to take confidential legal advice from the legal advisor to the Committee.
Following consideration of the legal advice, the public was readmitted to the meeting room and the Licensing Committee RESOLVED
(i) that the site outside 99 Church Road be designated for the purposes of street trading at 13m length, but only of a width extending from the edge of the pavement to the third bollard shown in the picture at Appendix C2 to the report.
The specific dimensions of the site, on this basis, to be provided by the Licensing Officer to the applicant when the licence is issued.
The reason for the variation to the designation applied for is that the Licensing Committee considered that designating the full width of the roadway would impede the free movement of pedestrians and cyclists.
(ii) that the Licensing Committee agree the grant of a licence for the site designated above on the Council's usual conditions and subject to the following further conditions based upon the response to the application received from the Fire Brigade:

Chairs, tables and barriers not to be fixed permanently to the ground

No decking or other items that could prove a trip hazard and increase the fire loading of the immediate area

The chairs and tables to be removed from the designated site and suitably stored at any time when the premises are closed.

The number of tables and chairs to be placed on the designated site to be advised by the Licensing Officer in discussion with the applicant.
